‪Rape Allegation: No Evidence Against D’banj – Nigerian Police.

The Nigeria Police have cleared popular Nigerian singer and songwriter D’banj, of the rape allegations levelled against him by a twitter user Miss Seyitan Babatayo.

D’banj and Seyitan

This was contained in a report signed by Deputy Commissioner of Police (DCP) Umar Sanda on behalf of Deputy Inspector-General of Police, Force Criminal Investigations Department, Force Headquarters, and obtained by the News Agency of Nigeria (NAN), on Saturday.

It would be recalled that the allegation led to strong social and media controversy with several declarations of the innocence of the singer by his fans and admirers coming up against those who believed Babatayo was telling the truth.

D’banj had claimed that there was no truth in the allegation and blamed it on the handiwork of his enemies who he alleged were out to destroy his hard-earned reputation.

The musician subsequently instituted an ₦1.5 Billion defamation lawsuit against Babatayo in spite of the support she got from prominent women rights groups.

However, the report by the police investigation unit did not find any substantial evidence to prove that D’banj committed the act and that Babatayo had withdrawn the petition filed against D’banj.

“This is a case of indecent assault on female, rape, intimidation and threat to life reported by Seyitan Babatayo through a petition letter dated June 5, 2020, by the Law firm of Ojoge, Omileye and Partners against Oladapo Daniel Oyebanjo a.k.a D’banj.

“The petition is to the Inspector-General of Police which was endorsed to the Deputy Inspector-General of Police FCID for investigation and further referred to the ACP SEB/PEPF for investigation and report.

“The fact of this case is that on Dec. 30, 2018, Mr Franklin Amudo who was a manager to the suspect invited the complainant Seyitan to an all-white party at Eko Atlantic in Lagos, where the suspect performed as a guest music artiste.

“The complainant alleged that D’banj had sex with her against her wish but in view of the foregoing facts, the investigation was discontinued as there was no substantial evidence to prove the allegation of rape against the suspect,” the report read in parts.

Meanwhile, Babatayo has denied the statement that she reached out to Human Rights Activist and #ENDSARS advocate, Mr Segun Awosanya, a.k.a Segalink, asking for his intervention in the rape case.

Babatayo urged her supporters especially STER, a non-governmental organisation to act with honesty in the matter even as she expressed appreciation for the group’s support so far.

Awosanya had equally demanded an apology following a statement from the nongovernmental organization that he was contacted by Babatayo on the matter.

He described the allegation as deliberate and mischievous falsehood intended to malign his person and reputation.

“I demand a retraction of the group’s statement and the issuing of an apology within the next 24 hours or a lawsuit will follow,” Awosanya said.

Man Utd Will Not Extend Alexis Sanchez and Chris Smalling’s Current Loan Deals With Inter Milan and Roma.

Manchester United will not be extending Alexis Sanchez and Chris Smalling’s current loan deals with Inter Milan and Roma.

Alexander Sanchez and Chris Smalling, both on duty for Inter Milan and AS Roma.

It is understood that United are unwilling to extend both players’ loans into next season or have them stay out on loan any further than the current arrangement, and are looking to reach a deal for a permanent transfer.

Smalling and Sanchez originally signed on one-year loans expiring in June, but had their stints in Italy extended until the first week of August in order to be able to play out the end of the Serie A season following the shutdown.

Under the current agreement the two players will return to Old Trafford after the last Serie A matchday, scheduled for August 2, meaning that neither will be able to play in the final stages of the Europa League.

Roma and Inter are yet to play their round of 16 one-legged ties against Sevilla and Getafe respectively, with the original first-leg ties in March being postponed due to the coronavirus pandemic in Italy and Spain.

Roma are a possible semi-final opponent for United while Inter may meet Ole Gunnar Solskjaer’s side in the final should they progress through to the decider in Cologne on August 21.

Smalling has scored two goals in 34 appearances for Roma this season, and the club are keen on tying the 30-year-old down to a permanent deal at the Stadio Olimpico.

Paulo Fonseca’s side have already secured an extension to Henrikh Mkhitaryan’s loan spell from Arsenal and will sign Chelsea winger Pedro on a free when his contract expires at the end of the season.

Fabinho’s Home Burgled As He Celebrated Liverpool’s Title Win.

Liverpool midfielder Fabinho’s was a victim of a burglary on Wednesday, with quite an amount of jewellery and a car taken from the football star’s home.

Thieves broke in to the Brazilian’s home on the day the Reds were presented with the trophy for their first top flight win in 30 years.

Items of jewellery and an Audi RS6 were stolen during the raid in Formby, Merseyside Police said. The car was later recovered in Wigan.

The burglary was discovered when the occupants returned.

Police said thieves targeted the footballer’s home sometime between 15:00 BST on Wednesday and 04:00 on Thursday.

Fabinho joined the Reds in 2018 in a deal worth more than ÂŁ40m and on Wednesday evening after an amazing season, Sir Kenny Dalglish presented the Premier League trophy to Liverpool after a 5-3 home win over Chelsea.

It would be recalled that at the end of last season, just after Liverpool’s UEFA Champions League triumph, former Reds star Daniel Sturridge’s house was also robbed with some jewellery and his dog stolen.

Fortunately the dog was found a few days later.

U.S. Court Dismisses Fraud Case Against Woodberry.

A United States court has dismissed the case against Olalekan ‘Woodberry’ Ponle, a Nigerian accused of multi-million dollar wire fraud.

Mr Ponle, popularly known as Woodberry, was arrested, alongside Ramon Abbas (Hushpuppi) in the United Arab Emirate on the 10th Of June for multiple fraud charges after a raid by operatives of the Dubai crime unit. The duo were extradited to the U.S. on the 2nd of July.

According to the complaint against Mr Ponle, an unnamed Chicago company was tricked into sending wire transfers totalling $15.2 million. Companies based in Iowa, Kansas, Michigan, New York and California also were victims of the fraud, prosecutors say.

It was reported that the Federal Bureau of Investigation (FBI) nabbed Mr Ponle through details accessed from his WhatsApp, iPhone and Bitcoin transactions.

The 29-year-old was facing charges bordering on wire fraud conspiracy at a United States District Court in Illinois. A report of the grand jury, a group of lawyers empowered to conduct legal proceedings and investigate potential criminal conduct had infact, indicted him for wire fraud.

Dismissal:

The United States government on Monday filed a motion through its attorney, John R. Lausch, requesting that the case against Mr Ponle should be dismissed without prejudice.

“Counsel for the government has spoken with counsel for the defendant and defendant’s

counsel has no objection to this motion.

Respectfully submitted,” Mr Lausch stated.

He said it is in pursuant with Federal Rules of Criminal Procedure 48, which states that the government may, with leave of court, dismiss an indictment, information, or complaint. Also, the government may not dismiss the prosecution during trial without the defendant’s consent.

A court order issued by Judge Robert W. Gettleman on Tuesday, said the government’s motion to dismiss complaint without prejudice was granted.

“Without objection the complaint against defendant Ponle is dismissed without prejudice. Motion presentment hearing set for 7/23/2020 is stricken,” Mr Gettleman ruled.

When a case is dismissed with prejudice, it is over and done with, once and for all, and can’t be brought back to court.

However, when it is dismissed without prejudice, like in the case of Mr Ponle, the dismissal is temporary as the prosecutor can refile the case within a certain period of time.

The probable causes of dismissal range from unavailability of sufficient evidence, an improper criminal complaint or charging document, to loss of evidence necessary to prove the defendant committed the crime.

While the press is yet to obtain the reason for the dismissal, there are indications that the prosecutor will re-file a case against him.

He is yet to be released from detention at the time of this report.
